The Party Wall etc. Act 1996 uses specific terms that can be confusing. Here’s an A–Z glossary of the most important party wall definitions and terms, explained in plain English.
A neighbour whose property may be affected by proposed works. There can be more than one.
A surveyor appointed solely to act on behalf of the Adjoining Owner.
One surveyor jointly appointed by both owners to act impartially for both sides.
The person (or company) planning works that fall under the Party Wall Act.
A surveyor appointed solely to act on behalf of the Building Owner.
When an Adjoining Owner agrees to the works set out in a Party Wall Notice.
When an Adjoining Owner does not consent, triggering the need for a Party Wall Award.
Arises when an Adjoining Owner dissents or fails to reply within 14 days of notice.
A boundary line where a new wall is proposed at or astride the property boundary.
Works covered by the Party Wall Act, such as extensions, loft conversions, or basement excavations.
A person living in or using a property affected by notifiable works (not always the owner).
Anyone with a legal interest in the property — freeholder, leaseholder, or long-term tenant.
Includes walls, floors, or partitions shared between properties, e.g. between flats.
A wall that stands on the land of two owners and forms part of a building, or divides two properties.
The legally binding document prepared by surveyors setting out how works will proceed and protecting both parties.
The formal notice served by the Building Owner to their neighbours before starting notifiable works.
A written and photographic record of the Adjoining Owner’s property before works begin.
A sum of money the Building Owner may have to lodge to cover potential costs if works are not completed.
An independent professional appointed under the Act. They must act impartially, even if chosen by one owner.
If two surveyors are appointed and cannot agree, a Third Surveyor may be called in to resolve disputes.
