When work falls within the scope of the Act, the Building Owner must serve a Party Wall Notice on the Adjoining Owner(s). If consent is not given, the parties are deemed to be “in dispute”. In this case, Party Wall Surveyors must be appointed to resolve the matter through a Party Wall Award (sometimes referred to as a Party Wall Agreement).

A Building Owner is the person or company planning to carry out works that fall under the Party Wall etc. Act 1996. They are usually the freeholder or a leaseholder with more than one year left on their lease.
You must serve a Party Wall Notice if you plan to alter a shared wall, build on or near a boundary, or carry out excavation close to your neighbour’s property.
As the Building Owner, you are normally responsible for the reasonable fees of the surveyor(s). This applies whether there is one Agreed Surveyor or separate surveyors appointed by you and your neighbour.
A Party Wall Award sets out how works should be carried out, working hours, and methods of construction. It also protects your neighbour by including a Schedule of Condition, so any future claims for damage can be resolved fairly.
