Party Wall Surveying – Adjoining Owner Surveyor

Christopher Anthony Surveyors were appointed by the Adjoining Owner on Ulverston Road, Walthamstow (E17), in relation to their neighbour’s proposed ground floor extension. As the works involved foundations and new walls on the boundary, a formal Party Wall process was required under the Party Wall etc. Act 1996.

Why our involvement was needed

The neighbour planned to build a new wall up to and partly on the boundary. As the Adjoining Owner had previously constructed a party wall, it was essential that the enclosure costs under Section 11(11) were correctly assessed. This provision ensures that if one owner later encloses upon an existing party wall, they must make a fair contribution to the cost of its construction.

Without professional representation, there was a risk of underpayment or disputes over what costs were recoverable.

Our role

• Reviewed the neighbour’s Party Wall Notices for accuracy and validity.
• Inspected the Adjoining Owner’s property and prepared a Schedule of Condition to protect against claims of damage.
• Assessed the Section 11(11) costs relating to the previously built party wall, ensuring the contribution was fair, reasonable, and backed by proper evidence.
• Negotiated the Party Wall Award with the Building Owner’s surveyor, covering working hours, methods of excavation, and protection measures.

Outcome

The final Party Wall Award safeguarded the Adjoining Owner’s property during construction and confirmed the correct enclosure cost payment. This avoided later disputes and ensured compliance with the Act.
